Certain professions in the health sector, referred to as regulated health professions, require practitioners to obtain an authorisation before being able to practice in the Grand Duchy.
Certain professions in the health sector, referred to as regulated health professions, require practitioners to obtain an authorisation before being able to practice in the Grand Duchy. The authorisation is issued by the Ministry of Health.
To obtain authorisation, candidates must meet the professional conditions and the physical and mental health conditions necessary for exercising their profession.
The regulated health professions are listed in Article 1 of the Law of 26 March 1992, as amended, on the exercise and upgrading of certain health professions.
Article 16 of the amended Law of 26 March 1992 on the practice and upgrading of certain health professions provides in particular that "the following shall be punishable by a term of imprisonment of between 8 days and 3 months and a fine of between 251 and 5.000 euros or by one of these penalties only: a) a person who practises one of these professions without being authorised to do so; b) a person who, without being entitled to do so, performs an act falling within the attributions of one of these professions; c) a person who, without being entitled to do so, uses a title designating one of these professions or any other title that may lead to confusion; …".
