  • Be aware on how employee reviews work in an evidentiary context or in establishing the evidence of non-performance;

Inhalt

In the context of the performance’s assessment, what does matter if the performance of the tasks or if the achievement of the objectives is challenged on both sides? If the conflict escalates or if the employment relationship terminates based on alleged underperformance, which criteria will a Labour court consider? How do Labour law and courts interpret professional inadequacy? Who carries the burden of proof with respect to underperformance and what should be proven on both sides?

Jackye Elombo (Avocat à la Cour), proposes to animate a Workshop on legal issues on performance assessment, which aims at answering these questions and key points as well as further practical questions you might have.

The Workshop will last 3 hours, and it will be divided into a theoretical part (Luxembourg case-law and doctrine on underperformance) and a practical part, where the participants will solve a case study, enabling them to practice in a playful and interactive manner the theory learnt.

The workshop is targeted to CEO and HR Managers involved in the performance assessment process.
